There is a saving in National Insurance for the employer and the worker if the worker is not an employee.  Many workers therefore try to avoid being categorised as an employee - and many employers try to do the same for their workers, which perhaps is not always for the workers' benefit short or long term.

How can a fair deal be structured for both parties ?

Of course if you are the worker and own the company 100%, you will receive directly or indirectly all of the benefit of saving National Insurance.

So at the Eacotts Breakfast we considered:

  • Is your worker really self employed ?
  • Might HMRC mount a successful challenge?  
  • Is your paperwork in order ?
  • if there is tax to pay, who is liable ?  
  • What is IR35 and how does it work?
